Win $1,000 in Vanilla® Prepaid Giveaway
NO PURCHASE NECESSARY
1. CONTEST PERIOD:
The $1,000 in Vanilla Prepaid Giveaway (the “Contest”) begins on September 5th, 2018 at 12:00:01 AM Eastern Time (“ET”) and ends on October 14th, 2018 at 11:59:59 PM ET (the “Contest Period”) after which time the Contest will be closed and no further entries shall be accepted. This Contest is sponsored by InComm Canada Prepaid, Inc. (“InComm”).
The Contest is open to residents of Canada who (i) have reached the age of majority in the province or territory in which they reside at the time of entry; and (ii) are not employees, representatives or agents of InComm, Alimentation Couche-Tard Inc. or their subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, representatives or agents. Void where prohibited by law. Contest is subject to all applicable federal, provincial and local laws.
3.HOW TO ENTER:
To enter the Contest, use one of two methods of entry outlined below. No entries will be accepted by any other means.
You may enter the Contest in one of the following two ways:
i. With Purchase: Purchase a Vanilla Prepaid Card at any participating Mac’s®, Circle k® or Couche Tard® store in Canada (“Eligible Purchase”) between September 5th, 2018 and October 2nd, 2018 (the “Eligible Purchase Period”), enter your card number, contact information and correct answer to the skill-testing question provided online at www.vanillaprepaid.com/contest before October 14th, 2018 at 11:59:59 PM ET and receive one (1) entry into the Contest (an “Eligible Purchase Entry”). There is a limit of one (1) Eligible Purchase Entry per Eligible Purchase.
ii. No Purchase Necessary Online Entry: Visit www.vanillaprepaid.com/contest, and enter your first name, last name, email address, and a minimum 250 word paragraph about “Why you love Buying Vanilla Prepaid Cards” in the space provided and correctly answer the skill-testing question provided and receive one (1) entry into the Contest (“No Purchase Entry”). There is a limit of one (1) No Purchase Entry per email address during the Contest Period.
Eligible Purchase Entries and No Purchase Entries referred to collectively as “Eligible Entries”.
Message and data rates may apply to Eligible Entries. Eligible Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Eligible Entry. For the purpose of the Contest Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet service provider or other organization responsible for assigning the submitted email address. Each selected entrant may be required to provide InComm with proof that the selected entrant is the authorized account holder of the email address associated with the selected entry. Message and data rates may apply. Eligible Entries must be received by InComm during the Contest Period.
4. PRIZES & PRIZE DRAWS
4.1 Prizes. At the start of the Contest Period, there will be one (1) Grand Prize per Region (defined below) and seventy-five (75) Secondary Prizes (collectively, the “Prizes”) available to be won.
i. Grand Prizes: There is one (1) Grand Prize available to be won in each of the following regions (each a “Region”)
- West (BC, Alberta, Saskatchewan, Manitoba and the Canadian Territories)
- Central (Ontario)
- Atlantic (New Brunswick, Nova Scotia, Newfoundland and PEI)
Each Grand Prize consists of $1,000 in Vanilla Prepaid Mastercard® Cards. The odds of winning a Grand Prize depend on the number of Eligible Entries received during the Contest Period in each Region.
ii. Secondary Prizes: There will be seventy-five (75) Secondary Prizes available to be won, each consisting of one (1) $100 Vanilla Prepaid Mastercard Cards. The odds of winning a Secondary Prize depend on the number of Eligible Entries received during the Contest Period.
The approximate retail value (ARV) of each Grand Prize is $1,000 and the ARV of each Secondary Prize is $100. Total ARV of all Prizes available to be won is $11,500. The number of prizes available to be won will decrease as awarded. Prizes must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise. InComm reserves the right in the event that a Prize cannot be awarded as described for any reason, to substitute a Prize with another prize of equal value, without any liability. In no event will more than the stated number of prizes be awarded. InComm will not replace any lost or stolen Prizes. Winners are responsible for all taxes and fees, if any, associated with Prize receipt and/or use. Vanilla Prepaid Mastercard Cards are subject to terms and conditions of use. Vanilla Prepaid Mastercard Cards are issued by Peoples Trust Company pursuant to license by Mastercard International Incorporated. “Mastercard” and the Mastercard Brand Mark are registered trademarks of Mastercard International Incorporated.
4.2 Grand Prize Draw. Four (4) random computer-generated draws (one for each region) for the Grand Prizes will take place at InComm’s headquarters in Atlanta, Georgia on October 15, 2018 at 1:00 PM ET after the end of the Contest Period from among all Eligible Entries received for the applicable region.
4.3 Secondary Prize: Seventy-five (75) random computer-generated draws for the Secondary Prizes will take place at InComm’s headquarters in Atlanta, Georgia on October 15, 2018 at 1:00 PM ET after the end of the Contest Period from among all Eligible Entries.
5. HOW TO CLAIM A PRIZE:
InComm will make reasonable efforts to contact potential Prize winners by email at the email address provided at the time of entry within ten (10) business days after the end of the Contest Period. InComm is not responsible for suspended or discontinued online or phone service which may result in a potential winner not receiving initial prize notification. In order to win, the selected winners must first correctly answer, unaided, a time-limited, mathematical, skill-testing question, and complete, sign and return a declaration of compliance with these Contest Rules and a liability and publicity release. If winner notification is returned as undeliverable or if a selected winner cannot be contacted within the time specified above, does not complete the necessary eligibility forms, does not correctly answer the mathematical skill-testing question, is not otherwise an eligible entrant, or does not otherwise comply with the Official Rules, he/she will be disqualified and will have no recourse towards InComm or anyone involved in the Contest. In the event that a potential Prize winner is disqualified for any reason, an alternate winner may be selected from among the remaining Eligible Entries for such Prize. Any alternate winner will have the same rights and obligations as the original winner.
The Prize delivery process will be as follows: within thirty (30) days after InComm verifies a Prize winner’s eligibility and receives the signed release forms, the Prize will be mailed by InComm to the confirmed winner at the address provided at the time of entry. If any Prize is returned as undeliverable, the Prize will be forfeited and InComm shall have no further liability to award that Prize.
Any other costs or expenses associated with the Prizes will be the responsibility of the winner.
Prizes will only be awarded to entrants residing in Canada.
6. GENERAL RULES:
InComm is not responsible for any lost, damaged, illegible, inaccurate or late entries or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit or affect in any way an entrant’s ability to participate in this Contest. InComm is not responsible for any typographical or other error in the administration of this Contest or in the announcement of the Prizes. InComm assumes no responsibility or liability for (a) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (b) inaccessibility or unavailability of the website on any particular day; or (c) technical, pictorial, typographical or editorial errors or omissions contained herein or in other materials related to the Contest.
The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases odds of winning; (2) non-compliance with these Contest Rules; and (3) any other act which InComm determines, in its sole discretion, jeopardizes the integrity of the Contest. InComm reserves the right (1) to disqualify any entrant and void any entries of an entrant who has engaged in unsportsmanlike conduct, fraud or other misconduct relative to this Contest or otherwise attempted to tamper with or impair this Contest; and/or (2) to cancel, modify, suspend or terminate this Contest, for any reason, including if, in InComm’s sole opinion, technical failures, applicable laws or regulations, unauthorized human intervention or other cause beyond InComm’s control destroys the integrity of this Contest or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of this Contest or any part thereof.
By entering the Contest, each entrant agrees to be bound by these Contest Rules and all decisions of InComm, which decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of the Prize winners.
By participating in the Contest, entrants agree to release and hold harmless InComm, and its parent, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, these Contest Rules will prevail, govern and control.
InComm will not assume any responsibility of any nature whatsoever in all cases where its inability to hold the Contest or to remit the prizes to the winners results from a cause beyond InComm’s control, including acts of God, weather conditions, strike, lock-out or other labour dispute.
Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should an attempt be made, InComm reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned or licensed by InComm and/or its affiliates.
The Contest is subject to all applicable federal, provincial and municipal laws and regulations and will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between any entrant and InComm in connection with the Contest will be governed by and construed in accordance with the laws of the Province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
For Quebec residents, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
